Legal expert highlights importance of pre feasibility study to prevent innovation failure

UNAIR NEWS The success of commercializing research-based products depends not only on technological sophistication, but also on compliance with regulations. Addressing this issue, 51动漫 (UNAIR) held an Expertise Capacity Building session for the Pre-Feasibility Study (Pre-FS) Expert Team. The activity was part of the fourth day of the Innovation Forum at DRI Week 2026, which took place on Friday, April 17, 2026, at Kahuripan Building, Management Office, MERR-C Campus.

A legal expert from 51动漫, Dr. Prawitra Thalib SH MH ACIArb, explained that many conventional products are able to remain in the market for a long time due to strong legal compliance, licensing, and intellectual property rights (IPR). He noted that many large-scale projects fail midway due to legal disputes.

Dr. Thalib explained that Pre-FS serves as an initial feasibility assessment stage before a research project advances further. 淢any innovation projects fail not because of financial or technical issues, but due to overlooked legal aspects, such as land disputes or licensing. This is where Pre-FS plays a crucial role as a preventive measure, he said.

He outlined four main outcomes of Pre-FS from a legal perspective: legal certainty, innovation protection, early risk mitigation, and cost efficiency. Without these elements, innovations risk being prohibited from distribution and investments may be stalled. 淩esearch downstreaming requires legal certainty to ensure safe investment. Therefore, identifying risk clauses and contractual needs must be carried out from the beginning, emphasized the Faculty of Law lecturer.

In addition to contract analysis, stakeholder synergy is also essential. 淚t is important to conduct a triple helix assessment that bridges government, business, and universities. This ensures that all interests are accommodated and the inventor檚 intellectual property is protected, he added.

Furthermore, Dr. Thalib emphasized that obtaining a Business Identification Number (NIB) through the OSS system is only the first step. Each technological innovation operates within specific regulatory frameworks and standards that must be followed. Errors in identifying sectoral permits can lead to serious consequences.

In his closing statement, Dr. Thalib highlighted the high risks of legal negligence by citing a real case in which millions of unlicensed products were withdrawn from the market, causing state losses amounting to tens of billions of rupiah in 2025. 淭his fact underscores that Pre-FS reports must clearly define legal risk mitigation. We must ensure that innovative ideas do not fail midway due to neglect of legal compliance and licensing requirements, he concluded.
