UNAIR NEWS– Article 36 Section 2 of Law No. 20 Year 2008 mandates KPPU (Business Competition Supervisory Commission) as an institution formed and tasked to oversee business competition.It is as regulated in the legislation to conduct supervision on the implementation of partnership arranged in an orderly manner.
The purpose of partnership supervision, among others, is to create partnership among UMKM (Micro, Small and Medium Enterprises) or UMKM with big enterprises and to encourage mutual relationship in business transactions.It is also aimed to develop cooperation to improve the bargaining position of UMKM.
On Monday, April 23, KPPU held a general lecture to Faculty of Law (FH) student of (UNAIR) who took business competition law course.There were two speakers, Kamser Lumbanradja (Commissioner of KPPU 2012-2017) and Romi Pradana Aryo (KPPU KPD Surabaya Representative).The lecture in the Hall of Pancasila was moderated by Ria Setyawati as the lecturer of business competition law.
Kamser stated that the partnership consists of four principles, mutual need, mutual trust, mutual support, and mutual benefit.
In addition, for a healthy partnership agreement, he added, five provisions are needed at least.They are business activities, rights and obligations of each party, form of development, duration, and settlement of disputes.
“The partnership should be mutually beneficial.However, in practice, most small businesses do not gain as big as big business practiotioners, “he said.
Furthermore, Yanuar explained the dominant position.As in article 1 of Law 5/1999, dominant position is a condition in which the business practitioner does not have a significant competitor in the relevant market in relation to the controlled market share or the business practitioner has the highest position among competitors in the relevant market in terms of financial ability, the ability to access on supply or sales, and the ability to adjust the supply or demand of certain goods or services.
The students were very enthusiastic in the general lecture.They acknowledged that in business competition, KPPU has an important role so details are very important.
