Contribution of Lecturer in Constitutional Law, Faculty of Law, UNAIR at The Global Summit on Constitutionalism 2023

Dr. Rosa Ristawati, Lecturer in Constitutional Law FH UNAIR as a Distinguished Research Fellow, Spring 2023 in the Program on Constitutional Studies, School of Law, the University of Texas at Austin, participated in the 2023 Global Summit on Constitutionalism organized by the Constitutional Studies Program in the University of Texas at Austin, March 16-18 2023. This forum is a global forum attended by scholars and academics in the field of constitutional law from more than 45 countries who discuss actual issues regarding constitution and constitutionalism, starting from theoretical subjects, methodology, and comparison to the fundamental issue of constitutional development from the aspect of formal amendments, as well as court decisions. The host of this forum is Prof. Richard Albert, the William Stamps Farish Professor in Law, Professor of Government, Director of Constitutional Studies at the University of Texas at Austin, and Founder & Director of the International Forum on the Future of Constitutionalism.

Dr. Rosa Ristawati, as the author of the book chapter entitled: The Integrative Model of Constitutional Amendments in Indonesia as Constitutional Communication in Professor Richard Albert’s book: The 淎rchitecture of Constitutional Amendment: History, Law, Politics (The Architecture of Constitutional Amendments: History , Law, Politics, Richard Albert (Anthology Editor) (https://www.bloomsbury.com/us/architecture-of-constitutional-amendments-9781509959082/) delivered a presentation at a panel session of 35 book chapters, on the issue of The Architecture of Constitutional Amendments This panel was chaired by Shamshad Pasarlay (University of Chicago), with presenters namely Catarina Santos Botelho (Universidade Cat贸lica Portuguesa), The Presentist Portuguese Constitution, Hui-Wen Chen (University of Warwick), When the Temporary Becomes Indefinite: Legitimacy, Path Dependency and Taiwan’s Hybrid Approach to Constitutional Amendment Codification, Caspar Pfrunder (University of St. Gallen), Codifying an Evolving Culture of Constitutional Pragmatism, Rosa Ristawati (Airlangga University) & Radian Salman (Airlangga University), The Integrative Model of Constitutional Amendments in Indonesia as Constitutional Communication, and Malkhaz Nakashidze (Batumi Shota Rustaveli State University), Georgia’s Model of Constitutional Amendment Codification.

On the panel, Dr. Rosa Ristawati reviewed and conveyed that the method for amending the 1945 Constitution, which the MPR officially agreed upon, was an addendum, which means maintaining and making the original text readable. Using the constitutional change model introduced by Prof. Richard Albert, from an Indonesian perspective, after the last (fourth) amendment in 2001, the MPR introduced an integrative method intended as political communication to the public to internalize Indonesia’s new constitution. This is because, historically, the early 1945 Constitution has been known to the public for a long time, so fast communication is needed to popularize the 1945 Constitution through methods that can be understood more quickly.

Apart from acting as a presenter, the Lecturer in the Comparative Constitutional study area is also the Chair of the second-panel session on the second day with the topic “Constitutional Law And The Judiciary: Theory And Practice”. Apart from participating in the series of Global Summit sessions, Dr. Rosa had the opportunity to become a partner in a class discussion session for Professor Richard Albert’s course, 渃onstitutional law with students. In this class session, Dr. Rosa shared her knowledge about the unchangeable clause in the Indonesian constitution.
