Redefining Indonesian Constitution Day

UNAIR NEWS –Indonesian Constitution Day is commemorated on August 18, 2008. The day coincides with the signing of the Indonesian Constitution Day Declaration by the Institute of Constitutional Studies, the Leadership of the People’s Consultative Assembly (MPR), and the Chairmen and members of the Regional Representative Council (DPD) and various components of Indonesian society.The idea on commemorating August 18 as the Indonesian Constitution Day began with an article written by Mochamad Isnaeni Ramadan with the title “Indonesian Constitution” published in the daily Suara Karya.

In response to the commemoration of Indonesian Constitution Day, the expert of Constitutional Law Faculty of Law Dr.Sukardi, SH, MH, said the constitution is the supreme law that can be understood also from its material.Sukardi also added that the constitution regulates the government with a society that contains human rights and marks the existence of a country.

“The constitution can be understood as the supreme law.From the material side, the constitution also regulates between the government and the governed that contains human rights and marks the existence of a country, “he said.

Regarding the discourse of returning the 1945 Constitution of the Republic of Indonesia to the original manuscript, expert on law drafting course said that if it is done, necessary and important points related urgency underlying the return is necessary.

“If we want to do the original manuscript conversion, we must determine the urgency.Because the 1945 Constitution is about a strong system of government.Whereas what now happens is the system ofchecks听补苍诲听balanceswhere no one institution has a super power.Between the legislative, executive, and judicial institutions have a balanced position in accordance with the meaning of the constitution regarding the distribution of power, “said Sukardi.

Regarding the suggestion what Sukardi suggested about the constitution, he said if the most important is how the legislators interpret the constitution in accordance with the contemporary concept because of it is multi-interpretative nature.
