The Center for Health Law Studies and the Criminal Law Department of the Faculty of Law, 51动漫 (FH UNAIR) collaborated to hold a Guest Lecture Series, “Efforts of the Surabaya POM Center in Preventing Illegal Cosmetics Circulation,” on Monday (3/4/2023). The guest lecture, which was held offline in Room 202 Building A FH UNAIR, invited Nur Zainab, S.Sc., Apt, as the Drug and Food Control Section of BPOM RI East Java.
The legal basis for prohibiting illegal cosmetics includes laws, government, presidential, and BPOM RI regulations. Based on Article 1 paragraph (1) of Presidential Regulation Number 80 of 2017, the Food and Drug Supervisory Agency (BPOM) is a non-ministerial government agency that carries out government affairs in the drug and food control field. Drugs and food controlled by BPOM include traditional medicines, health supplements, cosmetics, medicinal ingredients, narcotics, psychotropics, precursors, addictive substances, and processed foods.
“BPOM, according to the provisions of Presidential Regulation Number 80 of 2017 is given the authority to issue product distribution permits and certificates under safety standards and requirements. In addition, BPOM is also authorized to carry out intelligence activities and investigations in drug and food control and to impose administrative sanctions under statutory provisions,” said Nur Zainab.
In addition to overseeing the distribution of drugs and food, BPOM supports business actors’ independence and empowers the community to use safe, quality, and valuable products. The scope of BPOM’s supervision consists of 34 large offices or POM centers in all provincial capitals in Indonesia and 39 POM locations in districts/cities in Indonesia.
“BPOM in Surabaya has a working area covering 27 regencies and cities. There is also the Kediri POM location, whose working area covers six regencies and cities, and the Jember POM workshop, whose working area covers five districts and cities,” explained Nur Zainab.
“Supervision of drugs and food at the BPOM main office in Surabaya is divided into two levels of supervision: pre-market and post-market. At the pre-market level, BPOM is tasked with providing industry certification in drugs and food based on GMP, auditing the registration of drug and food products, and issuing recommendations for Commodity Exports and Imports. Meanwhile, at the post-market level, BPOM is tasked with inspecting facilities from the production to distribution stage, supervising advertising and product promotion, and providing technical guidance and education to the public,” he continued.
BPOM Surabaya has held various work programs such as CangKruAn, Si Abang, and the POM Clinic to support its performance. CangKruAn is a webinar to discuss specific topics held every two weeks thoroughly. Meanwhile, Si Abang (for Ready to Build the Nation) is a ball pick-up activity to remote villages to deliver integrated information, materials, CEK KLIK practices, and demonstrations of rapid testing of hazardous substances in food. Currently, Si Abang has targeted 78 locations with 18,914 people throughout 2022. Finally, there is the POM Clinic, which opens a question-and-answer service regarding drug and food safety for the community.
