Oil and Gas Draft bill, New Hope to Indonesian Oil and Gas Governance

UNAIR NEWS Faculty of Law 51 has held a national seminar on Legal Aspects of Oil and Gas Upstream Governance with Sovereignty and Justice, on Wednesday, May 5. It was held in Room 303 Building A of FH UNAIR and attended by 108 participants from undergraduate students, Notary FH UNAIR students, lecturers and the public.

The speakers in the seminar were Didik Sasono Setyadi (Special Executive Task Force of Upstream Oil and Gas), Didi Dwi Sutrisnohadi (Ministry of ESDM), Dewi J. Putriatni (East Java ESDM Agency), and Dr. Emanuel Sujatmoko (FH UNAIR academician).

In the seminar, Didik explained about the management of upstream oil and gas. He said that the management is related to the managing, contract drafting, monitoring and budgeting functions.

So, the land, the water and natural resources shall be under the power of the state but not only to have it under possession but also to entrust the power over them for the greatest benefit of the people. If the trust in law means a command. It means the country and specifically the government is commanded by the people through the 1945 Constitutions to exploit the natural resources for the benefits of the people, said Didik.

FH academician, Emanuel, explained about the allocation for the central and local administration regarding the oil and gas management.

There should be transparency on the state revenue from oil and gas sector and a monitoring is needed to watch over the fund especially for the basic education necessity, said the lecturer of Administrative Law.

The conclusion of the seminar was that the Oil and gas Draft bill is a new hope for oil and gas governance in Indonesia. The law number 22 in 2001 on Oil and Gas is no longer relevant with the latest condition. The paradigm of sovereign and just governance should be applied in oil and gas management so in the future, oil and gas can be the Indonesian economic driving force.

Furthermore, the committee also provided video conference for teleseminar from Universitas Bengkulu (Bengkulu), Universitas Syiah Kuala (Aceh), Universitas Mataram (Mataram), Universitas Cendrawasih (Jayapura), andSebelas Maret (Surakarta).
