UNAIR NEWS Deputy of the Corruption Eradication Commission (KPK) Alexander Marwata, emphasized that the functional procurement staffs (PBJ) should be brave in filing a report to local law enforcer or KPK if they are oppressed or threatened. It is usually the modus operandi used to corrupt the good procurement.
滵on檛 be afraid of oppression and threats such as being transferred, fired and other forms of threats. Report it to KPK, we will follow up. We must be brave to be honest, as it will save us from the legal entanglement, said Alexander Marwata, in the seminar held by DPN of Indonesian Procurement Functional Association (IFPI), in Garden Palace Hotel, on Saturday, March 25.
The seminar for the first anniversary of IFPI also invited a panel from BPKP of East Java and Professor of Faculty of Law 51动漫, Prof. Dr. Nur Basuki Winarno, SH., M.Hum. The seminar was attended by 160 goods/service procurement staffs of institutions and regions in Indonesia, moderated by Bambang Suheryadi, SH., M.Hum, Head of Procurement Service Center (PLP) UNAIR which was also the initiator of IFPI in Surabaya, 2016.
Consequently, there are many staffs rejected the offer for being the goods/service procurement officials and some candidate tried to fail the certification process just to avoid the position, on the other hand this position is a vital and important.
Head of the committee, Drs. Moh Imron, MM., said that the seminar entitled 淎ntisipasi masalah Hukum dalam Proses Pengadaan Barang/Jasawas held because of the condition in the field pose a great risk related to legal issues. So, the goals are to inform, educate and improve professionalism of PBJ management.
滷or 2016 APBN/APBD, for example, from Rp 2.095 trillion, 40% should be used for goods and service procurement and the 60% is for staff and other spending. With that considerable percentage, PBJ has a strategic role, said Moh. Imronfrom UNAIR.
The Deputy of KPK also said that planning is the most risky phases of PBJ. There have been members of DPR/DPRD involved even though technically legislative members are not related to it. But because there are nnegotiations related to APBD, collusion and fees, the legislative members often involved such as what happens to UPS procurement in DKI.
淚n the incorrect PBJ planning there is oppression, negotiation, collusion and also fee distribution, there is a fraud in the procurement auction. The prices are marked up, the publication is done with low quality media partners which the project report is also not well managed. This kind of case is easy to be revealed, said Alexander Marwata.
On the other hand, the regional election system (Pemilukada) currently applied does not show good implementation of PBJ spending. There are many candidates of the election being asked some fund by the party. This 渇und often found by Marwata ranged from Rp 25 M to Rp 30 billion.
淚f we calculate and compare it with the salary of a regent or a mayor, that much money will be difficult to get back, especially when it is borrowed. When they win, they will try hard to get more than they had spent. This collusion m.o. is often done by the head of regional administrations, there are 200 officials involved in this kind of cases, added Marwata.
Marwata hoped that PBJ will be implemented with E-planning, E-Budgeting,听补苍诲听E-catalogin all regional areas or institutions so PBJ can be realized and free of legal risks especially when the roles of regional inspectorate in local administrations is insignificant to prevent corruption as they are not independent.
